This morning DOJ designated New York City, Portland, and Seattle as anarchist jurisdictions. No Chicago, though DOJ says that it’s “continuing to work to identify jurisdictions that meet the criteria set out in the President’s Memorandum and will periodically update the list of selected jurisdictions.”  Thanks, Steve, for catching this!

For your radar: The Sept 2 Trump memorandum regarding withholding federal funds to certain localities required DOJ/DHS to develop an expanded list of “anarchist localities” within 14 days. This means they should be coming out with a list on or before Sept 16. This list may or may not include Chicago. And Law Department can jump in, but it seems like if they do not come out with a list within the time frame provided and without an addendum to the memorandum requesting more time, that is good for us and legal standing if/when they do come out with a list, as they did not meet their own guidance.

 

As a reminder, the guidance on which programs they can and will target is 30 days from Sept 2 (note that this is after the start of the new Federal fiscal year on Oct 1). I anticipate there is little they can actually do, but we’ll see.

    Sec. 3.  Restrictions on Federal Grant Funding.  To advance the policy set forth in section 1 of this memorandum: 

    (a)  Within 14 days of the date of this memorandum, and updated as appropriate but no less than every 6 months thereafter, the Attorney General, in consultation with the Secretary of Homeland Security and the Director of OMB, shall publish on the Department of Justice website a list identifying State and local jurisdictions that have permitted violence and the destruction of property to persist and have refused to undertake reasonable measures to counteract these criminal activities (anarchist jurisdictions).
